Terms

General terms

Version 1.0, valid from 8 September 2026. Opgepikt, Jochem Van Der Heyden, Sint-Gillis-Waas, company number 0553.894.645, hallo@opgepikt.com. This is an English translation of our terms in Dutch.

These terms apply to every agreement between Opgepikt and a customer. They are on opgepikt.com/voorwaarden and are shown and accepted when you sign up. If they change, you get at least thirty days' notice in advance.

1. What Opgepikt is

Opgepikt provides a digital telephone assistant for businesses. The assistant answers incoming calls when the customer cannot, answers questions on the basis of the information the customer provides, plans or notes appointments, and passes on messages and callback requests.

The assistant does not replace the business owner or staff. It is a tool that catches missed calls. Opgepikt does not give medical, legal, financial or any other professional advice, and the customer may not set up the assistant to do so.

2. A service based on artificial intelligence

The assistant works with speech recognition, artificial intelligence and speech synthesis. This technology can make mistakes: mishear a name or number, understand a question differently than meant, or note a detail incompletely. The customer acknowledges this and accepts that flawlessness cannot be guaranteed.

Opgepikt takes on an obligation of best efforts: it does what is reasonably possible to make the assistant work well and keeps improving the service. It does not take on an obligation of result regarding the correctness of each individual conversation.

3. Price and price changes

The price is 89.99 euro per month, including 250 conversation minutes. Extra minutes are charged at 0.25 euro per minute. There are no start-up costs. Opgepikt falls under the VAT exemption scheme for small businesses; as soon as that changes, VAT will be charged and announced in advance.

Opgepikt may change the price for a valid, objective reason: a demonstrable cost increase at the suppliers the service depends on (telephony, speech technology, AI models, payment processing), or an annual indexation. A price change is announced in writing at least thirty days in advance. During that period the customer can cancel free of charge; the new price then does not apply.

4. Availability

Opgepikt aims for the highest possible availability but does not guarantee uninterrupted operation. The service depends on external suppliers for telephony, speech, AI and hosting.

If an interruption attributable to Opgepikt lasts longer than 24 consecutive hours, the customer receives a proportional reduction on the next invoice for the duration of the interruption. That is the only compensation for unavailability.

5. Force majeure

Opgepikt is not liable for failing to perform the service, or performing it late, due to force majeure. This includes: outage, disruption, policy change or discontinuation at external service providers Opgepikt depends on (telephony, cloud, AI suppliers, payment provider), disruptions in telecom networks or the internet, cyber attacks, power outages, natural disasters, strikes, and government measures. In case of force majeure Opgepikt may temporarily suspend the service without owing compensation.

6. Liability

The total liability of Opgepikt, per incident and per contract year combined, is limited to the amount the customer paid to Opgepikt in the twelve months before the incident.

Opgepikt is not liable for indirect or consequential damage, including lost profit or turnover, missed or wrongly booked appointments, lost customers, reputational damage, loss of data, or damage resulting from information the assistant gave a caller.

These limitations do not apply in case of intent or gross negligence by Opgepikt, nor to what the law mandatorily provides otherwise.

7. The customer's responsibility for its own information

The customer enters what the assistant may say: business details, prices, opening hours, services, instructions and answers to frequently asked questions. The customer alone is responsible for the correctness, completeness, currency and lawfulness of that information, and for updating it in time.

Opgepikt is not liable for damage resulting from incorrect, outdated or incomplete information that the customer provided or failed to update.

8. No medical, legal or financial advice

The assistant gives no advice on health, treatments, medicines, legal matters or financial affairs. It refers questions about these to the customer. The customer may not set up the assistant to give such advice. This applies in particular to businesses in healthcare, the beauty sector and the liberal professions.

9. Call recording and transparency

At the start of every call the assistant introduces itself as a digital assistant and announces that the call is recorded. Opgepikt takes care of that announcement. The customer makes sure that its own use of the recordings and transcripts (listening, keeping, sharing) complies with the law, and informs its own customers where that is legally required.

10. Data processing

For the processing of conversations the customer is the controller and Opgepikt is the processor. The data processing agreement at opgepikt.com/verwerkersovereenkomst is an integral part of these terms.

Opgepikt uses subprocessors for telephony, speech, AI, agenda, e-mail and payment, including Twilio, Deepgram, ElevenLabs, Anthropic, Google, Vapi, Cal.com, Brevo and Mollie. Part of them are established outside the European Union; transfers take place under the standard contractual clauses of the European Commission or an equivalent mechanism.

Recordings and transcripts are kept for at most 365 days after the conversation, or shorter if the customer sets that, and are then erased. When the agreement ends, all data of the customer is erased within thirty days, unless the customer asks for an export beforehand.

11. Duration and cancellation

The subscription runs per calendar month and is tacitly renewed by one month each time. Both parties can cancel up to and including the last day of the current month; the cancellation takes effect at the end of that month. A month that has begun is not refunded.

When the agreement ends, the phone number that Opgepikt managed for the customer is released, and the data is erased as described in article 10.

12. Payment

The monthly fee is paid in advance by direct debit (SEPA) through the payment provider Mollie. The first payment confirms the mandate; after that the collection runs automatically.

If a collection fails, Opgepikt sends a reminder. If payment is still missing fourteen days after the reminder, Opgepikt may suspend the service (the assistant then no longer answers) after prior notice. If payment is missing for thirty days, Opgepikt may terminate the agreement. On overdue amounts the statutory interest rate for commercial transactions is due, plus a flat administration fee of 25 euro. The same interest applies in favour of the customer if Opgepikt makes a refund late.

13. Fair use

The 250 included minutes are meant for the normal telephone traffic of one business. In case of structural improper use, such as using the assistant for purposes outside the customer's own business, forwarding automated or mass traffic, or attempts to make the assistant do something that conflicts with these terms or the law, Opgepikt may, after notice, restrict use or suspend the service.

14. Intellectual property and use of data

The software, its workings, the prompts, the voices and all underlying technology of Opgepikt remain the property of Opgepikt. The customer receives a non-transferable right of use for the duration of the agreement. The customer remains the owner of the data it enters itself.

Opgepikt may use anonymised and aggregated data (such as numbers of calls, average call duration and sector statistics) to improve the service and to report on it, without individual customers or callers being recognisable. The content of conversations is not used to train AI models, unless the customer explicitly agrees.

15. Applicable law and disputes

Belgian law applies to these terms and to every agreement with Opgepikt. In case of a dispute the parties first try to reach a solution through mutual consultation. If that fails, the courts of the judicial district of East Flanders, division Dendermonde, have jurisdiction.

If a provision of these terms is void or unenforceable, the other provisions remain in full force. These terms are shown when you sign up and must be accepted explicitly; they can be consulted at any time on opgepikt.com/voorwaarden. The version that applies is the version in force at the time of signing up, unless a later version was introduced with thirty days' notice.
